Appellate
Overview
Our dedicated appellate partners at Pierson Ferdinand are with you every step of the way, from the early stages of your case to the final appeal. Our approach is comprehensive and client-centric, ensuring your legal needs are well addressed. We collaborate closely with our trial lawyers, providing invaluable insights in matters with significant appellate implications, including dispositive motions and jury charges.
Clients also trust us to work directly on appeal, either alongside their trial counsel or as replacements when necessary. We practice in federal and state courts across the country, handling bench and jury trials, interlocutory appeals, appeals from final judgments, petitions for mandamus, and petitions for discretionary review.
Experience
Our pretrial services include strategic consultation, preparation of pleadings, research, writing, and arguments for complex motions and responses, guidance on discovery issues, crafting jury questions, and the preparation of petitions for mandamus when challenging trial court errors. We also handle interlocutory appeals, addressing matters like the appointment of receivers, class certification, temporary injunctions, governmental immunity, and jurisdictional rulings.
In the trial phase, we consult on trial strategy, research, prepare, and argue motions in limine, ensure the preservation of error at trial, provide guidance on objections to evidence and witnesses, prepare and present jury charges, and craft trial briefs on complex topics.
Post-trial, we assist with research and drafting of the form of judgment, write and argue post-trial motions, including motions for a new trial, judgments notwithstanding the verdict, and motions to alter and amend judgments, among others.
When it comes to appeals, we handle the entire process, from writing the notice of appeal and consultation on supersedeas bonds or other security to the preparation of requests for the appellate record to final briefing and argument. We work closely with our trial partners to identify key issues for appeal, study and analyze the record in preparation for appellate briefs, and craft compelling written arguments. We also review and provide feedback on drafts of briefs by others, prepare and deliver persuasive oral arguments, research and draft motions for rehearing, and write petitions for discretionary review to the highest courts.
Pierson Ferdinand is your strategic partner in the appellate arena, providing comprehensive support at every stage of your case. Our team combines deep experience with a client-focused approach, ensuring your legal matters are well-managed.
