About

Kristin is a litigator with more than a decade of experience focusing on international commercial arbitration under the auspices of all major arbitral institutions and pursuant to diverse rules, investment arbitration, domestic arbitration, and international and complex commercial litigation in federal and state courts. Having tried cases from inception to trial and final hearing in arbitration, she is committed to helping her clients navigate their complicated issues with strategic vision and acumen.

  • Kristin has experience handling complex international and domestic disputes in a wide range of industries, among them energy and natural resources, construction, financial services, and technology. She counsels clients in their matters involving sophisticated contract disputes, business torts, partner and shareholder disputes, and deceptive and unfair trade practices. She has experience prosecuting and defending claims against sovereign states and state-owned enterprises in arbitration and federal court. Kristin has experience counseling clients and working on matters in English, Spanish, and Portuguese.

    As one of 35 attorneys, among them only 5 women, board certified by The Florida Bar in International Litigation and Arbitration, Kristin currently serves as Chair of the International Litigation and Arbitration Certification Committee. She is a Past President of the Miami-Dade Chapter of the Florida Association for Women Lawyers (MDFAWL), in addition to holding active roles in the Executive Council of The Florida Bar International Law Section.

Notable Experience

International Arbitration

  • Prevailed in international arbitration matter defending respondent Latin American distributor of audiovisual and automation products in CIESP arbitration seated in São Paulo, Brazil against Brazilian distributor seeking USD 15 million award, obtaining award of full amount of fees and costs.

  • Represented claimant Florida broker and distributor of industrial infrastructure used for energy and petrochemical manufacturers in ICDR arbitration seated in Vienna, Austria against Austrian manufacturer refractory materials.

  • Represented claimant Panamanian company in ICC arbitration seated in Miami, Florida with Jamaican substantive law against Jamaican company under Jamaican substantive law arising out of claims related to share purchase agreement.

  • Represented respondent Argentine energy company in ICDR commercial arbitration seated in Orlando, Florida against claimant Florida manufacturer and supplier of wet compression parts.

  • Represented claimant U.S. food distributor against a Jamaican supplier in an ad hoc arbitration governed by the UNCITRAL Rules, seated in Kingston, Jamaica and under Jamaican law, leading to a full award as the prevailing party on the merits.

  • Initiated investor-state dispute on behalf of claimant Florida energy company against Commonwealth of Australia related to inequitable securities law resulting in expropriation of gas turbines and other equipment; argued most favored nation clause to avail investor of bilateral investment treaty containing mechanism for settlement of disputes.

  • Represented respondent sovereign state in ICSID arbitration brought by Chilean and Swiss consortium concerning revoked airport concession, with proceedings in Spanish.

International Litigation in US Courts

  • Represented defendant Florida broker and distributor of industrial infrastructure in federal litigation against US subsidiary of foreign state-owned petrochemical company.

  • Represented family of assassinated foreign official in wrongful death action in Florida against co-conspirators criminally charged in United States.

  • Represented plaintiff Florida-based energy company against African sovereign state in USD 45 million federal lawsuit, obtaining settlement within 60 days of filing action.

  • Represented plaintiff Panamanian/Florida energy company in federal action against defendant African sovereign state and subdivisions thereof in action to recover USD 40 million, obtaining successful resolution at mediation.

  • Prevailed in non-jury trial for plaintiff Brazilian cargo aircraft company alleging breach of contract against defendant Florida distribution company.

  • Represented defendant sovereign state in seeking dismissal of federal suit involving claim for expropriation of assets, basing defense on Act of State Doctrine and Foreign Sovereign Immunities Act.

  • Litigated several petitions for discovery related to 28 USC § 1782.
