Kenneth Thompson is a seasoned trial lawyer and business litigator with more than 25 years of experience representing companies, executives, institutions and high net-worth individuals in high-stakes, business-critical disputes. He is particularly known as a go-to litigator for bet-the-company disputes where the outcome carries significant financial, operational, or reputational consequences.

  • Clients turn to Ken for his ability to quickly assess risk, develop decisive litigation strategies, and drive favorable outcomes in complex matters. His practice focuses on complex commercial litigation and other high-stakes disputes, including technology and intellectual property matters, franchise and distribution conflicts, corporate governance disputes, employment and internal investigations, and high-exposure tort and products liability defense. He regularly appears in federal and state courts nationwide and has extensive experience in arbitration and mediation.

    Ken’s approach is informed by his prior service as General Counsel and Chief Litigation Counsel of a global software company, where he managed the company’s litigation worldwide and advised senior executive leadership on strategy, risk exposure, and business operations across more than 100 countries. This in-house experience gives him a practical, business-oriented perspective that clients value in high-pressure situations.

    In addition to his litigation practice, Ken conducts internal investigations and advises clients on risk mitigation, compliance, and governance, often in anticipation of or parallel to significant disputes.

    Before joining Pierson Ferdinand, Ken was a partner at FisherBroyles LLP and previously practiced with Carlton Fields PA and Troutman Pepper LLP. He began his career as a Judge Advocate in the U.S. Army Judge Advocate General’s Corps, advising senior leadership on litigation, employment, and administrative matters and administering training on international and operational law.

    • Defended leading fraternal benefit society in a high-stakes software implementation dispute in federal court involving millions in exposure, resulting in favorable settlement and recovery for client.

    • Lead counsel for prominent multimedia development and animation production company in complex dispute regarding production of major motion picture, resulting in favorable settlement and recovery.

    • Represented leading U.S.-based environmental services company in wrongful death matter in state court involving potential eight-figure exposure, achieving favorable settlement at fraction of exposure.

    • Defended prominent entertainment law firm against infringement and related claims in federal court, obtaining a complete dismissal of all claims.

    • Defended U.S.-based precious metals dealer and trading platform operator in dispute arising from alleged undelivered shipment, achieving complete dismissal in two separate state courts.

    • Defended global IT and business technology services company against breach of contract and related claims in state court, resulting in voluntary dismissal of all claims.

    • Secured a complete defense verdict (jury trial) for a pediatric medical practice in an employment discrimination action brought by the EEOC.

    • Obtained a defense verdict (bench trial) for an industrial products manufacturer in a federal breach of contract dispute.

    • Defended global consulting firm in an eight-figure transnational dispute in federal court, achieving a favorable resolution with no client contribution.

    • Represented national franchisors in multiple disputes involving breach of contract and intellectual property rights in federal courts across the country.

    • Represented prominent film and television producers in contract and intellectual property disputes.

    • Represented founder and majority shareholder in ownership dispute arising from the acquisition of an energy company.
