About

Frances De La Guardia is an accomplished litigator and appellate counsel based in Florida, with experience in all aspects of litigation, with emphasis on commercial, insurance, products liability, employment, and land use litigation. She regularly practices in Florida’s state and federal courts, including in the U.S. District Court for the Southern District of Florida and the U.S. Court of Appeals for the Eleventh Circuit. Over her legal career, Ms. De La Guardia has managed hundreds of appeals and oral arguments as lead appellate counsel in five of Florida’s six District Court of Appeals, the Florida Supreme Court, administrative tribunals, and state circuit court appeals division.

  • Ms. De La Guardia began her career as a trial attorney for a boutique insurance defense law firm representing major insurance carriers and later expanded her trial practice serving as appellate counsel at trial and post-trial proceedings. During this time, Ms. De La Guardia was appellate counsel on the landmark case, Fabre v. Marin, on the apportion of fault of non-party tortfeasors before Florida’s Third District Court of Appeal and the Florida Supreme Court.

    Ms. De La Guardia then joined State Farm Insurance Company’s Miami Claims Litigation office to serve as appellate and trial consultant to 15 trial in-house litigation counsel and claims professionals on matters ranging from complex insurance coverage disputes, extra-contractual claims and as appellate counsel on third-party litigation.

    Ms. De La Guardia also served as senior staff attorney to the Honorable Melvia Green at Florida’s Third District Court of Appeal. She was also a law clerk at the 17th Judicial Circuit Court in Broward County where she clerked for Circuit Court Judges Robert Tyson, James Reasbeck, Robert Carney and Richard Eade.

    In the legal community, Ms. De La Guardia has held leadership positions, including her recent election as Vice President of Regions for the Hispanic National Bar Association (HNBA), the largest Hispanic Bar Association in the U.S. and its territories with more than 67,000 members. Prior to her election as Vice President of Regions, Ms. De La Guardia was HNBA’s Regional President for Region VIII in Florida. In 2020, she served as president of the Cuban American Bar Association (CABA) and served as a board and executive officer for more than seven years. Ms. De La Guardia has also served as a board member on the St. Thomas University School of Law Advisory Board and was recently appointed to serve on the advisory board’s executive board.

    In the public charitable services capacity, Ms. De La Guardia has served as president of the CABA Pro Bono Project, a nonprofit legal organization providing legal services to unaccompanied minors and veterans as well as domestic violence and human trafficking victims. She has also been recognized as a pro bono champion for hundreds of hours of pro bono legal representation including prosecuting a Hauge Convention child abduction trial, handling claims for asylum applicants, assisting Miami’s Hurricane Legal Relief Clinics Charity and traveling to Puerto Rico to assist the victims of Hurricane Maria by providing pro bono legal work.
