Representative Matters

  • RTI v Becton Dickinson, Antitrust litigation on behalf of inventor of retractable syringes, resulting in a settlement in excess of $150 million

  • Lopez v Caterpillar, Products liability action resulting in a jury verdict in excess of $56 million

  • Nye v Ingersoll Rand, Employee Benefits action on behalf of more than 50 executives of Dresser Rand; Successfully obtained summary judgment ruling on behalf of Plaintiffs with case confidentially settling during second week of damages trial

  • Rochester Medical v CR Bard, Antitrust and business disparagement action on behalf of designer and manufacturer of medicated catheters, resulting in a significant settlement

  • Daniels Sharpsmart v Tyco, Antitrust and Business disparagement matter on behalf of designer and manufacturer of safe syringe disposal devices, resulting in a significant settlement

  • Exaro Energy v Encana, Arbitration matter on behalf of oil exploration company, successfully settled before trial

  • Ploetz v NCAA, The nation’s first trial concerning brain damaging and CTE related to playing football; successfully settled after one week of trial

  • Lloyd v NCAA, Represented the family of a deceased collegiate football player who died at practice from complications associated with sickle cell trait. As part of a successful settlement, the NCAA agreed to mandate sickle cell testing and education. As a result, there have been non subsequent NCAA Division I sickle cell trait deaths, after averaging multiple deaths every year in the two preceding decades.

  • Hart v EA Sports, Class action lawsuit on behalf of NCAA football players for the use of their Names, Images and Likenesses in video games. The case was successfully settled, resulting in the first-ever legal payments to college athletes.

  • Chesapeake Energy v McClendon, successfully represented the gas exploration company in an arbitration concerning theft of trade secrets, breach of contract, and other claims against the corporation’s founder and former Chief Executive Officer

  • In re: Toyota Sudden Acceleration Litigation, Successfully settled dozens of individual cases and was a member of the MDL Steering Committee

  • In re: General Motors Ignition Switch Litigation, Successfully settled numerous individual cases and was a member of the MDL Steering Committee

  • ****** v Becton Dickinson, successfully represented an inventor of medical devices for claims of patent infringement and breach of a patent licensing agreement

  • Gamino v Shintech, Represented a man severely burned in a refinery explosion, resulting in a significant settlement soon after the commencement of discovery and retained experts determining the cause of the incident and parties responsible

  • In re: Vioxx Litigation, a member of the litigation team that handled numerous cases, including one resulting in a $256 million verdict, which was ultimately resolved in a global settlement

  • Torrey v IDSA, successful representation of over two dozen persons suffering from the effects of Chronic Lyme Disease but have been denied treatment

  • Castorena v Western, Representing the family of a man killed in a factory explosion, and served as a member of the MDL Steering Committee

  • Numerous other successful matters in a variety of litigation areas, including patent infringement, commercial disputes, products liability, employment disputes, medical malpractice, and catastrophic personal injuries.
