About

Ben is a New Jersey based labor and employment attorney with domestic and international experience and capabilities. His capabilities range from counseling small and midsize businesses on local employment laws to advising multinational corporations on complex cross-border employment issues.

  • Domestic Experience and Capabilities

    Ben’s domestic experience includes defending New Jersey and Pennsylvania employers against claims of discrimination, harassment, hostile work environment, wage and hour violations, and retaliation under the ADA, Title VII, ADEA, FMLA, FLSA, NJLAD, CEPA, NJWHL and PHRA, in state and federal courts at the trial and appellate level, as well as before the Equal Employment Opportunity Commission (EEOC) and state administrative agencies, such as the New Jersey Division on Civil Rights (DCR).

    He has experience representing public employers before the Public Employment Relations Commission and the New Jersey Office of Administrative Law. Additionally, Ben has fully litigated multiple disputes before labor arbitrators. This includes the first successful removal of a tenured teacher for inefficiency under the TEACHNJ Act.

    Ben also counsels employers on employee management and compliance with ever-changing employment laws.

    In addition to the above, Ben:

    • negotiates and litigates matters involving employer confidential information and trade secrets and employee restrictive covenant agreements;

    • counsels employers on union issues, collective bargaining negotiations, grievances, and unfair labor practice charges; and

    • conducts internal investigations on a wide range of matters, such as complaints involving harassment, sexual harassment, discrimination, whistleblowing, and alleged employer misconduct.

    International Experience and Capabilities

    In a global economy and remote-work world, now more than ever, employers and businesses need guidance on how employing and contracting with individuals in various countries throughout the globe will impact them. Ben’s international experience allows him to provide such advice. This experience includes:

    • Negotiating cross-border service and consulting agreements;

    • Helping companies navigate complex international team moves and restrictive covenant issues;

    • Engaging attorneys throughout the globe to guide clients on the intricacies of local laws; and

    • Arbitrating international disputes.

    Other Experience

    Active in the professional community, Ben currently serves as Executive Director, Southern New Jersey, of the Sidney Reitman Employment Law American Inn of Court.

    Prior to entering private practice, Ben served judicial clerkships with the Honorable Anne McDonnell, Presiding Judge, Chancery, Superior Court of New Jersey, Gloucester County, and the Honorable Richard S. Hoffman, Judge, Superior Court of New Jersey, Appellate Division. Ben’s clerkship experience has given him inside knowledge of the New Jersey court system upon which clients and colleagues often rely.

    While in law school, Ben served as Articles Editor of the Rutgers Law Journal (now the Rutgers University Law Review) and served judicial externship with the Honorable Renee Marie Bumb, United States District Judge, District of New Jersey.
